1. Who do these General Terms and Conditions apply to?

The following General Terms and Conditions apply to all orders via our online shop by consumers. The offer is aimed exclusively at individuals residing or with a delivery address in the United Kingdom. The Corporate Client GTC apply to businesses (e.g. resellers) and other non-consumers.

 

2. Contracting party and formation of contract

The purchase contract is formed with YO|YOGA AG, Holbrigstr. 8a, CH-8049 Zurich, Switzerland.

By displaying the products in the online shop, we submit a binding offer to conclude a contract for these products. You can initially place our products in the shopping cart without obligation and adjust your entries at any time before submitting your binding order; use the designated correction tools explained in the ordering process to do this. The contract is concluded on acceptance of the offer for the goods contained in the shopping cart by clicking on the order button. You will receive another confirmation email directly after the order has been submitted.

 

3. Delivery caveat

If the product you ordered is not available because our reliable suppliers have not delivered the products to us through no fault of our own despite the placement of an identical order, we will notify you immediately as soon as possible and may terminate the contract. Where you have already made payments, we will refund you these payments without undue delay.

Subject to timely supply to us by our suppliers, we will always aim to deliver promptly, but time for delivery is not of the essence. If part of the order is not immediately available because our reliable suppliers have not delivered the products to us on time through no fault of our own despite the placement of an identical order, we will supply the remaining goods at a subsequent date without charging for shipping costs again, provided this is reasonable to you. We accept no liability for any delay or failure to deliver products to the extent that such failure is caused by an event outside our reasonable control.

 

4. Prices

Prices are in GBP and include statutory value-added tax.

 

5. Terms of delivery and shipping costs

We only deliver by means of mail order. Unfortunately, you cannot collect the goods.

Shipping costs are added to the given product prices. You can find out more details about shipping costs here.

If no one is available at your address to take delivery and the products cannot be posted through your letterbox, we will leave you a note informing you of how to rearrange delivery.

If, after a failed delivery to you, you do not re-arrange delivery we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection, we may end the contract.

 

6. Payment

You must pay for the products before we send them to you. We accept payment by:

Credit card 

When placing the order, you supply us with your credit card details. After verifying you as the rightful cardholder, we will request your credit card company to initiate the payment transaction immediately after your order. The credit card company will automatically execute the payment transaction and will charge your card.

PayPal 

After placing the order, you will be redirected to the Paypal website. To pay the amount due via PayPal, you must be registered on their site or register first, confirm your identity by entering your login details and confirm the payment on PayPal. You will be provided with further information during the order transaction. PayPal will then automatically execute the payment transaction.

PayPal Express 

After clicking the button "Direct to PayPal", you will be redirected to the Paypal website to complete your order. In order to transact the order, process via PayPal and pay the invoice amount, you need to be registered on their site or register first and confirm your identity by entering your login details. There you can select the delivery address and payment method stored with PayPal and confirm the use of your data by PayPal. You will be provided with further information during the order transaction. You will then be redirected to our online shop where you can complete the ordering process. Once the order has been placed, we will immediately request PayPal to initiate the payment transaction. PayPal will then automatically execute the payment transaction.

Bank Transfer 

If you select bank transfer as the method of payment, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of the payment.

 

7. Right to cancel

Consumers have a legal right to cancel and in some circumstances, return faulty goods, as set out in our return policy. Businesses are not granted any voluntary right to cancel.

8. Retention of title

The goods shall remain our property until paid for in full.

 

9. Transportation damages

If goods are delivered with obvious damage, please point out these defects immediately to the delivery agent where possible, and contact us about the damage without delay. Failure to make a complaint or to contact us does not have any effect on your statutory rights or their enforcement, or on the warranty rights in particular. However, it will help us assert our own claims against the carrier and/or transport insurance.

 

10. Warranty and guarantees

We are obliged to sell goods which are in accordance with the contract. As a consumer, you have statutory rights in the UK.

Unless otherwise agreed, we do not provide any other warranties or guarantees, but some products are covered by manufacturer warranties. 

We assume no liability for descriptions by third parties, in particular those provided by other customers in customer reviews published in the online shop or on our social media presences.

The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colours of the products. Your product may vary slightly from those images. Product packaging may also vary from that shown in any images on our website.

 

11. Liability

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. For example, we shall always assume unlimited liability for claims due to damage that was caused by us, our employees or agents:

●      for death or personal injury; for fraud or fraudulent misrepresentation;

●      for breach of your legal rights, which include the right to receive products which are of satisfactory quality;

●      in case of warranty assurances, where agreed; or

●      for defective products under the Consumer Protection Act 1987.

Apart from these cases, our civil liability is limited to the direct damage foreseeable upon conclusion of the contract. Loss or damage is foreseeable if (a) it is obvious that it will happen or (b) at the time the contract was made, both we and you knew it might happen.

 

12. Assignment

We reserve the right to assign or pledge to third parties our right to recover any unpaid purchase price from you in connection with deliveries of goods, including any interest and the reasonable costs of recovering such unpaid amounts and interest from you.

 

13. Severance

If a court finds part of these terms illegal, the rest will continue in force. Each of these terms operates separately.

15. Governing law

These General Terms and Conditions are governed by English law and you can bring legal proceedings in respect of the products in the English courts. 

If you live in Scotland or Northern Ireland, you can bring proceedings in the English courts under English law, or in the Scottish courts under Scots law or in the Northern Irish courts under the law of Northern Ireland (as applicable).
